We don't much like reading a page full of legalese, and we're guessing you don't either. Unless of course you're getting paid to. In which case we completely understand. But since we don't expect more than a handful of lawyers to sign up to promote the Fetish Club, we're going to skip most of the legal language. We're just going to tell you how and when you'll get paid, list a few responsibilities you'll have, mention some common-sense business guidelines, warn you not to spam, and close with the usual disclaimers. You'll be paid weekly in U.S. dollars. For anything below $25 in a weekly pay period, the amount will be carried over until the next week. There are NO order processing fees of any kind subtracted from your commissions.
You can choose between two ways to earn income. If you choose the "Convert them for Life" plan, you'll be paid a minimum of 50% on all signups and all rebills for the life of each membership. If you choose the "Convert them for Cash" plan, you'll be paid a minimum of $28 on every signup.
On the "Convert them for Life" plan, you'll be paid 55% once you send 29 new orders during any particular month, 60% after 58 orders/month and 70% on sales over 144 orders/month. On the "Convert them for Cash" plan, you'll be paid $30 once you send 29 orders/month, $33 after 58 orders/month and $35 after 144 orders/month.
If you send us a webmaster who signs up for our program, we'll pay you 10% on all their sales too. Even if a webmaster just clicks one of your FetishClub banners and goes to the tour site first, CCBill will still credit you when they signup for the affiliate program later.
These requirements are either required by law, or they're to make sure that you get paid in full. To participate in our programs you need to:
1. Be at least 18 years of age, or 21 if that's is the age of majority in your country/state.
2. Use the linking codes we give you to identify the visitors coming from your site(s) so you can be paid when they sign up.
3. Keep your account information up-to-date and accurate, to avoid any delays in payments to you.
4. Provide a Social Security Number or Federal Tax ID Number (if you're based in the USA).
5. Operate your site(s) so that they don't violate any laws (such as 18 USC 2257 and others), or infringe on any third party rights (such as copyrights, trademarks, privacy, or other personal or proprietary rights), and make sure your site content is not libelous or illegal.
If we modify the terms of our program, which we don't foresee doing but do reserve the right to do, we'll post the changes here. We'll also notify you at the email address you've given us. You'll be able to continue participating in our program by accepting the new terms, or, if you prefer, you'll be able to withdraw from the program and be paid for all commissions you've earned up until that point.
You'll be promoting a site that's been online for nearly ten years, so you'll be expected to protect the good reputation it's earned over those years. We want you to send as much quality traffic as possible to our FetishClub tour pages, but we don't want traffic that causes problems for us. We're assuming that you're an adult webmaster, and therefore you know what we mean. If you're not sure, please contact us with your questions, and be sure to carefully read our No Spam policies.
Any affiliate caught spamming links to our site via email, newsgroups, instant messages, chatrooms, message boards, irc, or otherwise point traffic to us which causes complaints (beyond the normal number of idiots who complain about everything), will have all of their accounts terminated and will forfeit all commissions not yet paid. We're not saying you can't use email and other methods to market our site, only that you have to do it within acceptable guidelines. See the Acceptable Email Practices section below for details.
We have a strict zero-spam policy, but we do believe in using reputable opt-in lists to promote our site, in fact we've been doing it successfully ourselves for years. If you wish to use email to promote our site, you will need to fully comply with our Acceptable Email Policy. You can click that link to open a new window with more information when you need it. Please feel free to contact us about any marketing you'd like to do if you're not sure it fits our guidelines. We're here to help you succeed in any way we can, as long as it doesn't damage our reputation or our business.
If we end our affiliate program for any reason, or cancel your participation in our program(s), we'll notify you immediately and you'll be paid in full for all accumulated commissions up until that point, just as if you'd decided to withdraw from the program for reasons of your own. However, you should be aware that accounts which we terminate because a webmaster attempts to mislead, cheat, or defraud us in some way will forfeit all outstanding commissions. Some grounds for termination include: supplying incorrect or incomplete account information; spamming in any form; misrepresenting our site, the cost or terms of membership, or the content in the members area; or instructing surfers to signup and then cancel later. There may be other ways to get terminated, but those will definitely get you clipped. If we terminate your account, you won't be able to apply again unless you have our written approval. In the event our relationship does come to an end, for whatever reason, you'll need to cease using the FetishClub name and marks, and remove all FetishClub and CashFetish graphics from your site(s) as soon as possible.
Despite all of the services and support we provide to our affiliates, this is a very simple arrangement where our only actual liability is to pay you all of the outstanding commissions you earn, and to pay those earned commissions to you even if you decide to stop promoting our site. We do not, however, have any obligation to pay webmasters who are terminated for intentionally violating the terms of our program.
